Misty Hills Photography – Terms & Conditions

These Terms and Conditions govern your use of Misty Hills Photography services, including our website and our SMS and email communications programs. By using our services or opting into our communications, you agree to these Terms and our Privacy Policy.

1. Program Description

Misty Hills Photography may send SMS and email messages to users who opt in. Messages may include promotional offers, service updates, appointment confirmations, and appointment reminders. Message frequency may vary.

Thank you for choosing Misty Hills Photography. We’re excited to work with you and are committed to providing an empowering, professional boudoir photography experience. Below is a summary of our key terms and policies. Please refer to your full contract for the complete agreement.

Session Booking & Payment

  • A non-refundable session retainer of $350 is required to secure your session date.

  • The session fee does not include any images.

  • All image collections and products are sold separately.

  • Package pricing begins at $799.

 

Credit Card on File

  • A valid credit card must be kept on file.

  • Charges only apply in the event of a cancellation, no-show, or reschedule, per the terms below.

 

Cancellations & Reschedules

  • All cancellations must be submitted in writing.

  • Session fees and any payments made are non-refundable.

  • One complimentary reschedule is allowed with 30+ days’ notice.

  • Rescheduling or canceling within 14 days of the session: $200 fee.

  • No-shows or cancellations within 24 hours: $350 fee.

  • Reschedules are limited to within 6 months of the original session date.

 

Reveal & Ordering Appointment

  • Held within 14 days of your session.

  • All images not purchased at the appointment will be permanently deleted.

  • A second reveal appointment is not offered.

 

Studio Expectations

  • Please arrive on time with clean, dry hair and no makeup or spray tan.

  • Clients arriving late may be subject to cancellation or a $350 rescheduling fee.

  • No guests allowed unless approved in advance.

  • You must be 18 or older to book a boudoir session.

 

Editing & Image Rights

  • Only purchased images are edited and delivered.

  • Additional editing may incur a fee.

  • The photographer retains all image copyrights.

  • Clients may share images if credited and not altered in any way.

 

Final Sale Policy

  • All sales are final.

  • No refunds are given on session fees, image orders, or payment plans.

  • Payment plans must be arranged prior to the session.

 

Liability & Conduct

  • Misty Hills Photography is not liable for injuries, loss, or damage occurring on premises.

  • Clients must be sober and respectful during sessions.

  • Photographer reserves the right to cancel without refund if studio guidelines are not followed.

 

Model Release (Optional)

  • Your images will only be used for marketing if you give written permission via the model release form.

  • You may revoke permission at any time with a 90-day processing period but we cannot guarantee any previous images shared will be deleted. 

 

By booking a session with Misty Hills Photography, you acknowledge that you have read and agree to these terms. If you have questions or need clarification, feel free to contact us directly.

2. Consent to Receive Messages

By providing your phone number and opting in, you authorize Misty Hills Photography to send text messages to your mobile number. Consent is not a condition of purchase.

3. Opt Out

You can cancel the SMS service at any time. Just text "STOP" to the 217-506-1388. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

4. Opt In Again

If you want to rejoin after opting out, you can opt in again using the same method you used to enroll originally.

5. Help and Support

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at mistyhillsphotography@gmail.com or 217-506-1388.

6. Message Frequency and Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

7. Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

8. Privacy

9. Changes to Terms

We may update these Terms from time to time. Updates will be posted with a new Last Updated date.
